Uh also, we ask that um you treat every speaker with respect. Uh no applause, no booing, uh things like 6:596 minutes, 59 secondsthat. And please not line up at the podium either. When someone sits down, uh just go ahead and step up there. So, if anyone would like to speak to us tonight, now's your time. 7:167 minutes, 16 secondsDerek Dodson, 106 Chapman Drive. So, listening to the harmonica based reggae 7:247 minutes, 24 secondssounds of Tick Bryan at the beach in the Cayman Islands while reading tonight's 7:317 minutes, 31 secondscouncil packet of 639 pages when I stumbled upon this one-page 7:397 minutes, 39 secondsdocument whereby I immediately hopped on my personal drone and got back to Lebanon 7:477 minutes, 47 secondsfor this meeting. a preface about this one-page document. 7:537 minutes, 53 secondsThe final chapter of tomorrow morning's Wilson County 7:597 minutes, 59 secondsplanning meeting will be the proposed update of the land use plan. I would 8:088 minutes, 8 secondsexpect to see all of y'all at that 10 a.m. meeting. However, 8:168 minutes, 16 secondsy'all have been double crossed by the IDB, which has scheduled their meeting at 11:00 in the morning. How am I 8:258 minutes, 25 secondssupposed to be at two places at the same time at 11 in the morning? Same with you folks. 8:328 minutes, 32 secondsI believe you could do it, Darren. 8:348 minutes, 34 secondsI'm going to try. [laughter] If anybody can, you can. I will try and I may be the keynote speaker at both events. 8:438 minutes, 43 secondsSo the next topic is while I'm thankful for the grand efforts of all those who 8:528 minutes, 52 secondsput together the city budget, I know you're asking yourselves why did I vote against it? Well, I will disclose the reason in the future. 9:049 minutes, 4 secondsmy microphone. My last topic tonight is such an electrifying bombshell that I put it in writing and I have a 9:129 minutes, 12 secondscopy for each of you and the city attorney. 9:229 minutes, 22 secondsThank you. Thank you. Would anyone else like to speak? 9:349 minutes, 34 secondsPhilip Donnell, Maple Hill Road. Uh, good to see you all again. And I feel like I've got kind of a captive 9:429 minutes, 42 secondsaudience. [snorts] So, what Derek just shared with you, I became aware of today as well. And so, I 9:499 minutes, 49 secondsspoke with neighbors that back up to the 150 acres that was approved on January 20th to be annexed in for a development. 9:599 minutes, 59 secondsWhat I'm pitching to you is that we put a sewer plant there. And when I talked to the neighbors today, they said they 10:0610 minutes, 6 secondswould much rather have 50 or 60 employees coming and going on Maple Hill Road than the potential 311. 10:1410 minutes, 14 secondsIf you put 311 houses there, two people, three people possibly driving in and out of Maple Hill Road every day. I think it would be a really good fit. 10:2410 minutes, 24 secondsUh some folks had come to me and said that there's been no traction whatsoever from Summit Development. Money has not 10:3110 minutes, 31 secondsexchanged hands. That the contract is still ongoing on my aunt and uncle's property for 6.5 million, but only 48 10:4010 minutes, 40 secondsacres on the Tatum property is under contract. Not the whole 96. 10:4510 minutes, 45 secondsSo I don't know what that means to y'all, but it's been five months. My aunt and uncle are in their late 80s. 10:5310 minutes, 53 secondsFive months is a long time to be waiting on your money. So this property joins us 11:0011 minuteson the north side. The affluent line is on our property that goes out to the Cumberland. I think we can make a deal. 11:0911 minutes, 9 secondsThank you. Thank you. Anyone else like to speak? 11:1611 minutes, 16 secondsOkay, seeing none, um I'll move on to uh my comments. A couple things tonight. Uh 11:2211 minutes, 22 secondsfirst uh this is our last meeting before uh America's 250th anniversary and so we 11:2911 minutes, 29 secondshave some events coming up that I'd like to announce. Uh the first is July 3rd. 11:3411 minutes, 34 secondsWe're having a America 250th parade. Um that's on Friday night at 7 o'clock and 11:4111 minutes, 41 secondsum it'll begin here uh near the the city council or the near city hall and it'll end at the courthouse where uh there'll 11:4811 minutes, 48 secondsbe a ceremony there. Um the Chamber of Commerce um they handled the Christmas parade. So Andrea Wilkkey, they're 11:5511 minutes, 55 secondsworking on this one as well. And so um so I just want to announce that. Hope uh people come out watch the parade. It's u it's a one-time thing for this 250th. 12:0612 minutes, 6 secondsAnd so I appreciate everybody working on that, everybody who's taking part in the process. Um, and uh, if anyone wants to 12:1312 minutes, 13 secondsuh to enter the parade, uh, you can contact the the Love West County Chamber of Commerce or you can call up here to my office and we'll get you hooked up 12:2112 minutes, 21 secondswith that as well. So, um, so it's going to be a great night and um, just celebrate the 250th. And then on July 12:2812 minutes, 28 secondsthe 4th, we will have our um our, um, annual um, fireworks celebration at the fairgrounds. Uh, the gates open at 5:00. 12:3812 minutes, 38 secondsUh the event will be from 6:00 to 9:00. 12:4112 minutes, 41 secondsUm there'll be food trucks, music, activities for kids. Uh there'll be fireworks as always. Uh this year we have something special. We have some sky 12:4912 minutes, 49 secondsdivers coming in um for the 250th. And um but I will need to say this because of construction at the fairgrounds. Uh 12:5712 minutes, 57 secondsthe location of the event is actually being moved to the green space off of Payton Road. Um so so it'll be back there on the back side of the 13:0513 minutes, 5 secondsfairgrounds. Uh the two ways into the fairgrounds is gate four uh which is the old Daniels Market location. Then gate 13:1313 minutes, 13 secondssix which is off Payton Road. Uh so we hope everyone comes out for that celebration against the 250th and um 13:2013 minutes, 20 secondswe've added some things to it. So uh but it has been moved and um so hope everyone comes out and has a great Fourth of July celebrating America's 13:2813 minutes, 28 seconds250th. Um also have one other thing I can talk about. Um, and it's actually something that that happened happened last night. 13:3813 minutes, 38 secondsUm last night uh the county commission uh vote on a resolution um to oppose uh 13:4613 minutes, 46 secondssome potential sewer plant uh locations and um historically um you know we've 13:5413 minutes, 54 secondshad a good work relationship with county government and I've heard Mayor Hutto speak a lot of times and and the two things that he has has always mentioned 14:0414 minutes, 4 secondsis that there's two things he has to do as a as a county mayor as a county government. one he has to educate and the other one he has to incarcerate. Um 14:1314 minutes, 13 secondswell he cannot do that without our sewer. 14:1614 minutes, 16 secondsUm so here's a list of county schools that are on our sewer in our city limits. Lebanon High School, Wilson 14:2514 minutes, 25 secondsCentral High School, Southside, the Adult Learning Center, the Adult High School, the Barry Tatum Ma uh Academy, 14:3414 minutes, 34 secondsand that does not count the central office that runs the county school system. Those are all in the city limits. There are also two schools 14:4114 minutes, 41 secondsoutside of city limits on our service system. That's Glavo Elementary and Glaval Middle. Um, in addition to that, 14:5014 minutes, 50 secondsuh, some of you may remember that earlier this year the new Lardo Elementary School was a bind because they built a building and their step system had not been approved by Tekk. 15:0115 minutes, 1 secondSo, we came in, this city council approved an agreement to help them out so they could open their school and they could pump and haul to our sur plan 15:1015 minutes, 10 secondsuntil they could get that situation resolved. And they cannot open that school without us. 15:1615 minutes, 16 secondsThat's right. In addition to that, they started building the Central Pike Elementary School without an approved 15:2215 minutes, 22 secondsstep system. It turns out that the West County Water Authority cannot serve that. 15:2915 minutes, 29 secondsSo you guys just a few weeks ago approved an agreement that their Central Pike Elementary School 15:3715 minutes, 37 secondswill be on our sewer system and it's not in the city limits. 15:4215 minutes, 42 secondsUm, also the everex expanding Wilson County Jail is an arcer system and we call it a 15:5015 minutes, 50 secondscounty jail, but I think a lot of people actually consider it a prison complex because it's gotten so big up there. 15:5615 minutes, 56 secondsThey are currently building a huge new court building. There's a courthouse, all the buildings at the fairgrounds, there's county offices throughout the city that are on our sewer system. 16:0816 minutes, 8 secondsIn addition to that, uh, 20some years ago, the city of Lebanon agreed to build a sewer line all the way to the Russian line for the national super speedway. 16:2016 minutes, 20 secondsSo all that, all those buildings you see at 840, those warehouses, those gas stations, 16:2716 minutes, 27 secondsum, all that economic growth out there, the property taxes, the sales taxes, all go to the county is on our service system. 16:3816 minutes, 38 secondsand they ask for more every day out that corridor all the time they're asking for more. 16:4516 minutes, 45 secondsSo a huge chunk of county economic growth is because of our service system. 16:5216 minutes, 52 secondsNow there's other ways we've worked for the county as well. the Expo Center. 16:5716 minutes, 57 secondsAbout 10 years ago, the C11 agreed to build $300,000 worth of water and sewer lines for the Expo Center and to pay $100,000 a year every year for 20 years. 17:1017 minutes, 10 secondsWe have 10 years left on that. 17:1317 minutes, 13 secondsUm, we pay more to that building every year than Farm Bureau does to have their name on it. 17:2017 minutes, 20 secondsAlso, historically, we have put in front of the city council to wave fees for buildings that the county are building inside the city limits. 17:3017 minutes, 30 secondsSo, I feel like we have worked well with the county government. Thank you. 17:3617 minutes, 36 secondsAnd we serve the county government. Our sewer serves the county government. 17:4517 minutes, 45 secondsLebanon is the economic engine that drives this county. 17:5017 minutes, 50 secondsWe have a bigger economy than Mount Juliet. Now, I can go through the stats on that, but I've said them a lot. 17:5717 minutes, 57 secondsSewer runs this engine. 18:0118 minutes, 1 secondSo, tonight I want to say to the county leaders, the county mayor, and the county commissioners. 18:0718 minutes, 7 secondsThe success of Wilson County depends on the success of Lebanon. 18:1218 minutes, 12 secondsAnd to the citizens of Lebanon, I want to say this. You live in Wilson County, too. 18:1918 minutes, 19 secondsYou also pay county property taxes, which right now that that tax rate is $116. 18:2718 minutes, 27 secondsOur tax rate is 40 cents. 18:3118 minutes, 31 secondsAnd inside the city limits, we provide a lot more services than the county does. 18:3818 minutes, 38 secondsSo I'm saying tonight, Lebanon does more for Wilson County than Wil County does for Lebanon. 18:4318 minutes, 43 secondsAnd I have sat up here and some and the counselors have too and we have heard people talk about 18:5118 minutes, 51 secondsLebanon like it is a pariah sucking the life out of the county and that is far from the case. In fact, it is the opposite. 19:0119 minutes, 1 secondSo I'm saying tonight this server plant will be built. 19:0619 minutes, 6 secondsThe committee is going to pick a site and we're going to buy it. 19:1219 minutes, 12 secondsand some county commission re resolution is not gonna stop us. 19:1719 minutes, 17 secondsCouncelor Carmarmac, thank you for saying that, Mayor. Um, with that being said, I know we have the 19:2419 minutes, 24 secondsexpo center out there and I want people to be aware of how much money we actually make off that. 19:3219 minutes, 32 secondsYou know, Lindsay and and Sarah can can work on that report. I I don't know what we make off of it. Um, I do know this. 19:4019 minutes, 40 secondsOkay. Well, I do know this. Most of those events out there are one day events and people get off the interstate, go to the expo center and 19:4719 minutes, 47 secondsget back on the interstate. Um, you know, one of the things I will say about the fairgrounds is is this. 19:5619 minutes, 56 secondsWe spend a lot of overtime hours with our LPD working events out there. 20:0220 minutes, 2 secondsNot only LPD, but you have the street department out there, too. And the sanitation department. You have the fire department. got a truck out there and and we get nothing for it. 20:1320 minutes, 13 secondsI about say Mike comes Do you break even? 20:1920 minutes, 19 secondsI think we had to amend the budget by two or $300,000 for that overtime. Did we not? 20:2720 minutes, 27 seconds[laughter] 20:3120 minutes, 31 secondsOvertime break even. do not. 20:3520 minutes, 35 secondsNo, we had to we had to do a budget a pretty pretty hefty budget amendment. Yeah. 20:3820 minutes, 38 secondsTo correct months ago. A lot a lot to do with the fair. 20:4520 minutes, 45 secondsJust want that to be known. That's all I got. Thank you, councelor Ashley. 20:5120 minutes, 51 secondsUm I appreciate those comments, mayor, but I don't have anything else to say. Thank you, Council Bailey. 20:5620 minutes, 56 secondsI appreciate those comments, too. Um, you know, I think a lot of education needs needs to be had 21:0521 minutes, 5 secondsand that I hope that the wastewater treatment plant committee um can help educate and I appreciate those comments. 21:1421 minutes, 14 secondsNow, I do have a question and maybe this is um to our attorney. Can we rescend any of these uh ordinance we we've just passed? 21:2421 minutes, 24 secondsAbsolutely. Unless it's uh something that is or agreements binded us into an agreement. Um but if 21:3221 minutes, 32 secondsit's just a resolution to support or you pass something to approve something, you can always rescend it. Yes. 21:3921 minutes, 39 secondsCan we rescend the one we passed two weeks ago? You got to be more specific than that. 21:4321 minutes, 43 secondsThe given the what is it? Central Pike School. Yes. Can we resend that? Sure. What's the ordinance number? But that's an agreement, right? 21:5121 minutes, 51 secondsWell, has been executed. I would have to look at several things to be able to properly answer that question, but it has been executed. 21:5921 minutes, 59 secondsIt has what? It's been signed. Uh the mayor and the city attorney. 22:0622 minutes, 6 secondsUm Yes. Yes. And school. And the school. 22:1422 minutes, 14 secondsSo it's been the agreement's been executed. So is it refundable or not? Not if it binds us to an agreement. No. 22:2222 minutes, 22 secondsIs there not a um there's some kind of provision in it that gives us Is there a provision that gives us a walk out time? 22:3222 minutes, 32 secondsMight have to read it again to see if if there is. You want this, Andy? Sure. Yeah. 22:5022 minutes, 50 secondsThis was the one for our house. Okay. 22:5622 minutes, 56 secondsI know uh this has been brought up before too. Um the $100,000 to the expo center. Is that an agreement? I know you've told us before we can we can resend that and stop paying it. 23:0623 minutes, 6 secondsThat one could go. 23:0823 minutes, 8 secondsYeah, that wasn't an agreement. That was just a ordinance of the or resolution of the city council just committing to do it doing it. 23:1523 minutes, 15 secondsDo you know the number? 23:1723 minutes, 17 secondsNo. [laughter] Um good memory. I I I I think I think um Council Car I've been thinking about 23:2423 minutes, 24 secondsthat one today. Um and um um I asked Lindsay to pull it up for me and um we're working on it. 23:3623 minutes, 36 secondsSo I would expect to see that coming up in the near future. 23:4323 minutes, 43 secondsI'm jumping out of turn here, but I had one other question. Um is that okay? Yeah, it's okay. Go ahead. 23:5023 minutes, 50 seconds[laughter] 23:5123 minutes, 51 secondsGo ahead. That's good. 23:5323 minutes, 53 secondsWhen you're talking about the expo center, are you talking about proceeds from the fair? What about proceeds from the fair? That's a separate issue, right? 24:0024 minutesUm, so I I I I think I can talk about this halfway educated. So the fair is 24:1024 minutes, 10 secondsrun by Wil County Promotions, which is a nonprofit organization. So the $100,000 we pay to the expo center goes to the Wils County government to run the expo 24:1824 minutes, 18 secondscenter. Um the proceeds from the fair go to the nonprofit and then they take part of that money 24:2724 minutes, 27 secondssave it for next year's fair and then what then they put part of the money into the grounds. So that's a separate entity that has an agreement with the 24:3624 minutes, 36 secondscounty government. Um and we don't have anything to do with that agreement. Right. 24:4424 minutes, 44 secondsWe're in the negative. 24:4524 minutes, 45 secondsThat's okay. And um I want to say uh thank you to Historic Lebanon. We've had some great Rock the Blocks. Um, even 24:5324 minutes, 53 secondsthough I couldn't attend, I did set up for or I did attend the last one, but um, I did help set up for a couple and 25:0225 minutes, 2 secondsum, I think it went real well and it's always exciting to be downtown and meet new people and and I appreciate all our 25:1025 minutes, 10 secondshelp from um, LPD and um, historic Lebanon's time that they do [snorts] put into doing great events for us. And that's all I have. 25:2025 minutes, 20 secondsThank you. Before I go to councelor Crow, Andy, did you did you have an answer for that agreement? 25:2525 minutes, 25 secondsYeah, it's a very brief agreement. Uh, basically we have we can terminate upon a default. 25:3125 minutes, 31 secondsSo if if the school fails to live up to any of its provisions in here, it's we have four things we can do which include 25:3825 minutes, 38 secondsuh suspend acceptance of wastewater disconnect service, pursue damages or enforcement remedies or seek any other re relief available at law or equity. 25:4725 minutes, 47 secondsThose are our four uh avenues. And then we can always uh terminate by mutual agreement. 25:5625 minutes, 56 secondsSo that's [snorts] so that that's the answer for that agreement. So that's a no deny, right? 26:0626 minutes, 6 secondsIt would currently seem to be a no based on what I've heard. Yeah. 26:1426 minutes, 14 secondsOkay. Thank you, Councelor Crow. 26:1826 minutes, 18 secondsMayor, thank you. Um, just to kind of um, I guess piggyback a little bit on councelor Birdine there, the uh, the Rock the Block series, four concerts on 26:2726 minutes, 27 secondsthe square. Uh, we can't control the weather. Uh, we got rained out a couple of times. They moved it to um the Capitol Theater and uh, to the mill. 26:4026 minutes, 40 secondsAnd actually uh, if you attended and went inside the Capitol Theater, the the acoustics are fantastic and it was air 26:4626 minutes, 46 secondsconditioned. So, uh, uh, it it actually was a really good concert. And then the one at the mill, I think, helped, uh, the folks who are are over there, uh, 26:5526 minutes, 55 secondsthe folks who have businesses there. So, I think everything everything worked out. The last one, it featured um Tall Paul, uh, which has been around long 27:0327 minutes, 3 secondsenough to, uh, uh, to remember some days, some good days at UT, Mayor. Uh, there were some people that in Murphy'sboro. Yeah, he he's been around 27:1227 minutes, 12 secondsa while and and does a great job. So, a lot of fun and uh and and so much u uh fellowship there to see folks come in 27:2027 minutes, 20 secondsand and shop around the square and um and uh enjoy that as well. So, also just briefly wanted to u 27:2927 minutes, 29 secondsuh recognize Miss Ball in the audience tonight. This is the second and final reading on a couple of items related to the BA aviation 27:3827 minutes, 38 secondsyouth education center and uh that'll be uh fantastic for for the kids um in our community for people of all ages. We're 27:4627 minutes, 46 secondsgoing to have uh uh activities hopefully starting there later this year and she's got lots of great connections throughout 27:5327 minutes, 53 secondsthe state and the region and uh it be a real benefit to our community. So I appreciate uh what she's doing there and all the others that'll be involved. 28:0128 minutes, 1 secondThank you, mayor. 28:0228 minutes, 2 secondsThank you. Uh before I go to councelor Brian, um I was Friday night at Rock Block, saw Council Bird there and councelor Crow. I 28:1028 minutes, 10 secondsknow you were there, but um somebody asked me how old was tall Paul and I said, "Well, he was at MTSU 35 years ago when I was there." So, I'm not sure 28:1828 minutes, 18 secondswhere that puts him, but he's he's been around a long time. So, councelor Brian, not that long ago. Just relax. 28:2328 minutes, 23 seconds[laughter] 28:2628 minutes, 26 secondsHe's a lot older than me. I know that. I'm 68. So he he's probably 78. 28:3228 minutes, 32 secondsI don't know how old he is. [laughter] But how many I'm going to do a little historical thing here. How many were in 28:4028 minutes, 40 secondsLebanon living here in Lebanon in 1969 and remember the Cesquin Centennial? How many remember that? Derek Conrad. 28:5128 minutes, 51 secondsAnybody? Anybody else? I was living here. 28:5428 minutes, 54 secondsWere you even alive then? You were 28:5728 minutes, 57 seconds[laughter] 28:5828 minutes, 58 secondsI was living here, but I I was one year old. So, you're one year old. 29:0229 minutes, 2 secondsWell, I was here uh for that and I think I was 12 years old at that time. And 29:0829 minutes, 8 secondsthen in 1976 was our 200th anniversary of our country. Uh that was the year I graduated high school, 1976. 29:1829 minutes, 18 secondsAnd I just wanted y'all to know that 29:2029 minutes, 20 seconds[laughter] 29:2729 minutes, 27 seconds[gasps] 29:2829 minutes, 28 secondsThank you, Council Brian. Council Morehead. 29:3029 minutes, 30 secondsWell, that's tough to beat there. Uh, I do want to thank the mayor for all the comments about uh what the city actually does for the county. But at the same 29:3829 minutes, 38 secondstime, uh, Council Bird and Carmarmac, we were at that meeting yesterday. A few of you people that I see out here were at 29:4529 minutes, 45 secondsour meeting yesterday that went for a couple hours. Uh, I just want you to know, but I can't speak for everybody, but I do not have an intention of 29:5429 minutes, 54 secondsforcibly taking away somebody's property that does not want to sell their property. I'm hoping out of all of those sites that we will have some willing 30:0230 minutes, 2 secondssellers and we will be able to negotiate a deal and we will put a brand new wastewater system in that will service all of Lebanon and obviously some of 30:1130 minutes, 11 secondsthese other places that are not in the city limits. But just I want to throw that out there. Another thing I want to mention more for the benefit of all the 30:1930 minutes, 19 secondscity employees. I don't know if any of you are aware of this. Um, I sit on the Tennessee Municipal Bond Fund board and we do a lot with the Tennessee Municipal 30:2830 minutes, 28 secondsLeague and I was at a meeting yesterday downtown and I don't know if anybody is aware of this but Wilson County Motors 30:3530 minutes, 35 secondsuh on Hartman Drive and on uh West M West Maine. Uh, anybody who works for 30:4230 minutes, 42 secondsthe city of Lebanon, if you buy a new or used car, regardless of whatever the best price is you've negotiated, you 30:5030 minutes, 50 secondswill get an extra $500 discount because you are an employee of the city of Lebanon. You're you're because the city is a member of the Tennessee Municipal 30:5930 minutes, 59 secondsLeague. So, any city that belongs to the Tennessee Municipal League right now, an 31:0531 minutes, 5 secondsemployee could get a $500 discount on a new or used car at Wilson County Motors. 31:1131 minutes, 11 secondsAnd I just thought that something that people ought to be aware of because I'm sure people have bought cars there and left $500 on the table that they don't need to. 31:1831 minutes, 18 secondsHow long? 31:2031 minutes, 20 secondsFor a couple years. And I talked to uh the Bones and said not one single person has taken advantage of that yet. So, I'm 31:2831 minutes, 28 secondstrying to let people know and hopefully somebody will take advantage of that and save $500. 31:3431 minutes, 34 secondsI wouldn't mind a 10% finders fee if you decide to use that, but [laughter] uh there is a big parade on the the 31:4231 minutes, 42 secondsthird. Uh and I hope everybody can come to that. If you can't make the third, Five Oaks is having our annual golf cart 31:5031 minutes, 50 secondsparade at 6 PM that will circle the neighborhood with golf carts that are festively decorated and we will have a judging for there. So, if you missed the 31:5831 minutes, 58 secondscity parade, please come to the golf cart parade. It'll be quite enjoyable. 32:0232 minutes, 2 secondsUm, and then I do also want to shout out to the fire department and the police department today. There was a bad 32:0932 minutes, 9 secondsaccident at Five Oaks Golf Course and the I had never seen squad cars drive down cart paths before, but I did today. 32:1732 minutes, 17 secondsIt was pretty impressive. And having the fire department out there uh taking a lady driving across 10 and 11 fairways to get her out of there, get her to the 32:2532 minutes, 25 secondshospital. Uh you guys, all of your team did a fantastic job and I want to make sure that they're aware. I I went outside, talked to a few of them, let 32:3332 minutes, 33 secondsthem know that I appreciated the work they did and uh please pass that along. 32:3732 minutes, 37 secondsBut that's all I have. Um, and before we start discussion, let me let me read the letter that was that was sent to me, 36:1536 minutes, 15 secondsthen we'll have discussion. Um, this was uh sent to council Berdine myself uh from Wayne Oakley. It says, "Mayor Bell 36:2436 minutes, 24 secondsreviewing the agenda of June 16, 2026, city council meeting. I read there is a proposed ordinance 267438 that will 36:3336 minutes, 33 secondscreate a design review board. I would have attended the council meeting to voice my support for this ordinance. 36:3936 minutes, 39 secondsHowever, 11 Youth Baseball softball association is hosting the 8 under softball district tournament and I'm required to be at Barrett Park as I am 36:4736 minutes, 47 secondsthe tournament director. I'm asking that you please read this email stating my support for the creation of a design review committee. As I have discussed 36:5536 minutes, 55 secondswith you in the past, I feel a design review committee would be a great asset for the city of Lebanon. While our planning staff at commission is doing a 37:0237 minutes, 2 secondsgreat job, a design review committee made up of design professionals will be able to provide professional input into submitted developments. Architects and 37:1037 minutes, 10 secondsengineers are required to keep with the advancement of construction materials which are continually changing and design styles. A design review committee 37:1837 minutes, 18 secondswill assist the planning staff and commission by viewing submitted developments from a professional standpoint and help alleviate the appearance of personal preferences. In 37:2637 minutes, 26 secondsaddition, a design review committee has prescribed in the ordinance will allow for more thoughtful design standards and design freedom by as an example not 37:3637 minutes, 36 secondslimiting design professionals to dictate a percentages to all design such as percentage of openness on buildings. As 37:4337 minutes, 43 secondsa licensed architect, I have never been taught or instructed that great designs achieve by trying to meet prescribed percentages. Rather, great design is 37:5037 minutes, 50 secondsthat which fits into the surrounding environment while functioning for the building's intended use. This along with our required continuing education 37:5837 minutes, 58 secondsrequirements help to ensure that we are protecting the health, safety, and welfare of the public. We'll also keep up with the latest developments in design and construction standards and 38:0638 minutes, 6 secondsmaterials. I hope the city council will advance this ordinance with a positive vote at tonight's council meeting. Thank you for taking the time to read and present my positive support for a design 38:1438 minutes, 14 secondsreview committee for the city of Lebanon. It's the Wayne Oakley. So, uh, with that, I will open for discussion. 38:2338 minutes, 23 secondsI I just got a question. Is this is just for the Hartman overlay, my understand, not citywide. 38:3038 minutes, 30 secondsAnd then this is only pertaining to if they're asking for a variance from city 38:3738 minutes, 37 secondscode as is. So I I just want to have a better understanding before I vote yes or no for this of exactly what I'm voting on. Josh, do you want to step up? 38:4638 minutes, 46 secondsCouncil B, do you want Well, yes. Josh can explain it better, but our goal in uh when we did the comprehensive plan was to put together a architecture uh design review committee. 38:5838 minutes, 58 secondsIt got voted down um because it was within that packet of of zoning changes. 39:0539 minutes, 5 secondsUm we are hoping and then we are growing to be a bigger city that uses a design review committee and so we're hoping to 39:1439 minutes, 14 secondsstart with the Hartman area and move forward to 39:1939 minutes, 19 secondsyou know further but I'll let Josh so to just address your questions this 39:2839 minutes, 28 secondsordinance is written to establish the commission for the entire citywide u that way you don't have to come back and do it again if you want to expand their 39:3539 minutes, 35 secondsauthority, but how it's written, their authority is comes from title 14, which is the zoning code, which has many 39:4239 minutes, 42 secondsdifferent things in it that give planning commission responsibilities, board of zoning appeals, city staff, but the one place in there that's different is the South Hartman overlay that 39:5139 minutes, 51 secondsactually calls out for a design review commission. Of course, we don't have one currently, so the planning commission fills that role until we do. Uh, so we were putting this forward. Uh the 40:0040 minutesimmediate effect of it would be that they would only look at plans within the south apartment overlay. If we want to expand that, that would have to go 40:0740 minutes, 7 secondsthrough the planning commission and city council to amend title 14 to expand their authority elsewhere in the city. 40:1340 minutes, 13 secondsUh how that process works for site plans within the Hartman overlay, it's a staff review only plans right now that don't go to planning commission typically 40:2140 minutes, 21 secondsunless there is a request for a modification and in this case those requests would just go to this com new commission instead of planning commission. Everything else would stay the same. 40:3240 minutes, 32 secondsOkay. 40:3440 minutes, 34 secondsMayor, I would just add to that from the planning commission standpoint. Um, I think 40:4140 minutes, 41 secondsstarting with the Hartman overlay. Let's see how it goes. I mean, this this could be a good thing. Um, you know, but if it 40:4940 minutes, 49 secondsif it gets off track, then we can we can readress it. But to start with the overlay that's already in place, it's probably a good place to start. 40:5640 minutes, 56 secondsYeah. No, your opinion means a lot to me as as well because you do sit on planning commission. I know when I first got on council three and a half years ago, planning commission was seemed a lot more weward than they are today. 41:0741 minutes, 7 secondsThey seemed to be running a lot tighter ship. Things are a lot better than they were. I that's why I wasn't sure if there was a if you felt there was a need 41:1541 minutes, 15 secondsfor this or not. And I like at least then you're saying if they're asking for a modification, it goes to this committee, not the planning then planning commission to ask for they 41:2341 minutes, 23 secondswould go to this committee. So they're we're not adding multiple steps, I guess, to the process because I would hate to in any more than they already are trying to get through our process. 41:3441 minutes, 34 secondsJust from my standpoint, I don't think I would be ready for it citywide at this point, but the overlay is a good place to start. The overlay already has a lot of restrictions on it anyway, right? 41:4441 minutes, 44 secondsUm and you know, hopefully we get some experts on there. I know the mayor has got appointments and got some ideas on who to appoint. So, you know, in theory, 41:5241 minutes, 52 secondsif we have experts, it could add add value, but if it doesn't, you know, we'll look at it later. Second motion by councelor Carmarmac. 45:1845 minutes, 18 secondsSecond by councelor Crow. Discussion. Some questions about this. 45:2245 minutes, 22 secondsUm, is this one of those mass tors that we end up getting a nickel on at the end of the day or something? I just was curious 45:3045 minutes, 30 secondsabout how we got involved with the PO lawyer that is somewhere out in the middle of nowhere. 45:3545 minutes, 35 secondsAnd you can probably explain that much better than I could. 45:3945 minutes, 39 secondsIs her name? um late last year, earlier this year, a law firm down in Louisiana and New Orleans named Stag Louisa, and 45:4645 minutes, 46 secondsthat's who we're hiring here, um filed a lawsuit against the chemical companies DuPont and 3M, and they ended up having 45:5545 minutes, 55 secondsthe lawsuit class uh sanctioned as a class action suit. 45:5945 minutes, 59 secondsYeah. And so really the the class became utility in the nation and they approved 46:0846 minutes, 8 secondsuh settlements in tiers and so the tier one settlement where you people like Nashville and the bigger utilities uh 46:1746 minutes, 17 secondslike that. Uh now it's time for the tier 2 utilities and they do it based on customer size uh to file a claim if 46:2646 minutes, 26 secondsindeed we want to file a claim. And so, uh, I've met with, uh, the attorneys, uh, they've explained it to me. There's 46:3446 minutes, 34 secondsa a Tennessee, a local Tennessee attorney that will actually be, uh, part of the litigation team because they needed somebody here in Tennessee. Uh, 46:4346 minutes, 43 secondsand if [clears throat] we pass this and agree to it, uh, the law firm will represent us in the class. Um we will we 46:5246 minutes, 52 secondswill get a settlement and they've got a matrix about your flow rate, number of customers and that sort of thing to determine uh what your settlement would 47:0047 minutesbe. Any fee, any testing, any costs uh would all come out of that settlement agreement. We don't have to pay them 47:0847 minutes, 8 secondsanything for upfront. And so what they're the what they're doing is just 47:1547 minutes, 15 secondsthose those chemical companies are responsible for some of the bad things that are in our water now, right? It just typically these turn out to be nickels and the lawyers keep all 47:2347 minutes, 23 secondsthe money. But I'll be curious to hear what we get. 47:2547 minutes, 25 secondsWell, I can tell you pre preliminarily based on the matrix, we're looking between one and two million. 47:3347 minutes, 33 secondsReally shocking. Okay. Well, we'll take that. [clears throat] 47:3747 minutes, 37 seconds[laughter] 47:3847 minutes, 38 secondsAll right. Any further discussion? All in favor say I. 47:4247 minutes, 42 secondsAny opposed? Thank you. That is the end of tonight's agenda. Uh thank you everyone for being here. We are done.
